Tamworth Tourist Information Centre Act 1992 (NSW)

An Act to enable the Council of the City of Tamworth to construct and operate a tourist information centre, a coach interchange facility and associated tourist facilities on certain land at East Tamworth now constituted a public reserve.

Tamworth Tourist Information Centre Act 1992 (Private Act) An Act to enable the Council of the City of Tamworth to construct and operate a tourist information centre, a coach interchange facility and associated tourist facilities on certain land at East Tamworth now constituted a public reserve. WHEREAS: (1) Certain land at East Tamworth was reserved as follows: • R. 54862 for public recreation and baths, notified 23 September 1921, • R. 65741 for public recreation, notified 10 January 1936, • R. 67553 for public recreation, notified 29 April 1938 and 18 February 1966 (addition), • R. 77258 for public recreation, notified 26 November 1954. (2) These reserves were revoked in 1972 and the whole of the land in them was reserved from sale for the purpose of public recreation (R. 88781 for Public Recreation, notified 24 November 1972). (3) The land has been occupied by the Council of the City of Tamworth since 1950 and part of the land is currently used and operated by the Council as a caravan park (known as the Paradise Caravan Park). (4) Under section 37AAA of the Crown Lands Consolidation Act 1913 the land, being Lot 10 in Deposited Plan 786997, was vested in the Council of the City of Tamworth for an estate in fee simple (subject to certain reservations) and was declared to be a public reserve for the purposes of the Local Government Act 1919 (notified 25 March 1977). (5) The Council wishes to construct and operate a tourist information centre, a coach interchange facility and ancillary facilities on that part of the land that is not currently being used as a caravan park. (6) The Council has no authority under the Local Government Act 1919 to construct and operate such buildings on a public reserve within the meaning of that Act: The Legislature of New South Wales therefore enacts: 1 Name of Act This Act may be cited as the Tamworth Tourist Information Centre Act 1992. 2 Commencement This Act commences on the date of assent. 3 Survey of certain land (1) The Council of the City of Tamworth may cause a survey to be made to determine the boundaries of the part of the land described in Schedule 1 that is: (a) referred to in the second recommendation of the Select Committee of the Legislative Assembly upon the Bill for this Act, as set out on page 3 of the report of that Committee, and (b) shown shaded on the map set out in Appendix C to that report. (2) The Director-General of the Department of Conservation and Land Management, if satisfied as to the accuracy of the survey, must cause a notice setting out those boundaries to be published in the Gazette. The land comprised in those boundaries is referred to in this Act as the surveyed land. 4 Council may construct and operate certain tourist facilities The Council of the City of Tamworth is by this Act authorised to construct and operate the following structures on the surveyed land, after the date of publication of the notice referred to in section 3 (2): (a) a tourist information centre and ancillary facilities, (b) an interchange facility (or terminal) for passenger coaches and buses. Schedule 1 The public reserve (Section 3) All that piece and parcel of land situate at East Tamworth in the City of Tamworth, Parish of Tamworth and County of Inglis, being Lot 10 in Deposited Plan 786997.
