The Parliament of South Australia enacts as follows:
1—Short title
This Act may be cited as the Returned Services Badges Act 1952.
2—Interpretation
In this Act—
the League means the league formerly known as the Returned Sailors' Soldiers' and Airmen's Imperial League of Australia (South Australian Branch) Incorporated and at the time of the passing of the Returned Servicemen's Badges Act Amendment Act 1975 known as the Returned Services' League (South Australian Branch) Incorporated;
returned services badge means a badge of a kind issued by the League, whether before or after the commencement of the Returned Servicemen's Badges Act Amendment Act 1975, for the purposes of indicating that the wearer of the badge is a member of the League.
3—Unauthorised use or possession of badges
	(1)	A person who is not a member of the League shall not wear, or without lawful excuse, have in his possession—
	(a)	any returned services badge; or
	(b)	any badge similar to a returned services badge, or so nearly similar to a returned services badge as to be likely to deceive.
Provided that it shall not be an offence against this section for any person who has ceased to be a member of the League to wear or have in his possession a returned services badge lawfully obtained by him while he was such a member.
	(2)	A person who contravenes this section shall be guilty of an offence.
Penalty:
For a first offence, twenty dollars.
For a subsequent offence, fifty dollars or imprisonment for not more than one month.
4—Proceedings for offences
Proceedings for offences against this Act shall be heard and determined summarily.
