South Australia Little Sisters of the Poor (Testamentary Dispositions) Act 1986 An Act to apply certain testamentary dispositions in favour of the Little Sisters of the Poor for the benefit of poor persons residing at the nursing home or hostel conducted by Southern Cross Homes Incorporated at Myrtle Bank; and for other purposes. Contents 1 Short title 3 Certain dispositions to benefit Southern Cross Homes Incorporated Legislative history The Parliament of South Australia enacts as follows: 1—Short title This Act may be cited as the Little Sisters of the Poor (Testamentary Dispositions) Act 1986. 3—Certain dispositions to benefit Southern Cross Homes Incorporated (1) Subject to subsection (2), a testamentary disposition— (a) expressed to be in favour of— (i) the Little Sisters of the Poor South Australia Incorporated; or (ii) the Little Sisters of the Poor at Glen Osmond; or (iii) the Little Sisters of the Poor at Myrtle Bank; or (b) expressed in some other manner to be in favour of the Little Sisters of the Poor, or the work of the Little Sisters of the Poor, in this State, shall be deemed to be a disposition in favour of Southern Cross Homes Incorporated for the benefit of poor persons residing at the nursing home or hostel conducted by Southern Cross Homes Incorporated at Myrtle Bank. (2) Subsection (1) does not apply to a testamentary disposition that is subject to an express or implied condition that the nursing home at Myrtle Bank must be conducted by the Little Sisters of the Poor. (3) The execution (before the enactment of this section) of a testamentary disposition of a kind referred to in subsection (1) is not invalidated by the retrospective operation of this Act. (4) A reference in this section to a testamentary disposition extends to a surrender or release effected by a testamentary instrument.
