New South Wales: Yass Roman Catholic Church Trustees Enabling Act (NSW)
An Act to enable the trustees of a certain allot- ment or parcel of land in the town of Yass, granted to the Right Reverend William Lanigan and others as trustees of the Roman Catholic Church at Yass, to sell the said land and to provide for the application of the proceeds thereof.

Yass Roman Catholic Church Trustees Enabling.
An Act to enable the trustees of a certain allot-
ment or parcel of land in the town of Yass,
granted to the Right Reverend William
Lanigan and others as trustees of the Roman
Catholic Church at Yass, to sell the said land
and to provide for the application of the
proceeds thereof. [18th September, 1900.]
HEREAS by a deed of grant bearing date the second day of
October, one thousand eight hundred and eighty-two, under the
hand of His Excellency Sir Augustus William Frederick Spencer
Loftus, the Governor of the territory of New South Wales, and under
the seal thereof, Her Majesty Queen Victoria did, for the consideration
in the said deed mentioned, grant unto the Right Reverend William
Lanigan, the Reverend Patrick Dunne, and Morgan O'Connor, their
heirs and assigns, an allotment or parcel of land in the town of Yass,
which land is more fully described in the Schedule hereto, to hold unto
the said Right Reverend William Lanigan, the Reverend Patrick Dunne,
and Morgan O'Connor, as trustees of the Roman Catholic Church at
Yass, their heirs and assigns for ever: And whereas the said Morgan
O'Connor died on the twelfth day of August, one thousand eight hun-
dred and ninety-five: And whereas by an indenture bearing date the
eighteenth day of May, one thousand eight hundred and ninety-one, made
between the Right Reverend William Lanigan of the first part, the Very
Reverend Patrick Dunne of the second part, and the Very Reverend
Patrick O'Keefe, and Phillip Julian of the third part, the said Very
Reverend Patrick Dunne resigned from the trusts of, and in connection
with, the said allotment or parcel of land, and by the same indenture
the said Right Reverend William Lanigan appointed the Very Reverend
Patrick O'Keefe and Phillip Julian trustees of the same in the place
and stead of the said Very Reverend Patrick Dunne and Morgan
O'Connor, and the said allotment or parcel of land has accordingly
become and is now vested in the said Right Reverend William Lanigan,
the Very Reverend Patrick O'Keefe, and Phillip Julian as such trustees
as aforesaid: And whereas the said allotment or parcel of land is not
required for a site for the Roman Catholic Church, nor for the enlarge-
ment of the present site of the Roman Catholic Church in the town of
Yass: And whereas the said Right Reverend William Lanigan, the Very
Reverend Patrick O'Keefe, and Phillip Julian, as such trustees as afore-
said, are desirous of selling the said allotment or parcel of land, and
of applying the proceeds of such sale in or towards the enlargement,

maintenance, and support of a Roman Catholic school or schools and
teachers' residence or residences in the town of Yass: Be it therefore
enacted by the Queen's Most Excellent Majesty, by and with the advice
and consent of the Legislative Council and Legislative Assembly of
New South Wales in Parliament assembled, and by the authority of the
same, as follows :—
1. From and after the passing of this Act it shall be lawful for trustees authorised
the said Right Reverend William Lanigan, the Very Reverend Patrick * sll.
O'Keefe, and Phillip Julian, as such trustees as aforesaid, their heirs
or assigns or other the trustees or trustee for the time being of the
land described in the Schedule hereto, to sell and dispose of the said
land by public auction or private contract, and either in one lot or in
several lots as they shall deem expedient, for such price or prices as
ean reasonably be obtained for the same, and to convey and assure the
same or any part or parts thereof when sold to the purchaser or pur-
chasers thereof in fee-simple freed and discharged from all trusts
affecting the same. And the receipt in writing of the said trustees,
their heirs or assigns or other the trustees or trustee for the time being
of the said land, for the purchase moneys arising from such sale or
sales shall be a sufficient discharge to the purchaser or purchasers of
the said land, and shall exonerate him or them from seeing to the
application of the said moneys and from all liability in respect of the
misapplication or non-application thereof.
2. The said trustees, their heirs or assigns or other the trustees Application of

possessed of the moneys arising from such sale or sales as aforesaid
upon trust to apply the proceeds thereof in or towards the enlargement,
maintenance, and support of a Roman Catholic school or schools and
teachers' residence or residences in the town of Yass. And the receipts
of any person or persons to whom any moneys shall be paid by the
suid trustees, their heirs or assigns or other the trustees or trustee for
the time being of the said land, or of the proceeds of any sale thereof
uader the provisions of this Act, shall be valid and complete discharges
to the said trustees, their heirs and assigns or other the said trustees
or trustee for the time being for such moneys.
8. This Act may be cited as the '' Yass Roman Catholic Church Short title.

THE SCHEDULE.
All that piece or parcel of land in the Colony of New South Wales, containing
by admeasurement thirty-two perches, be the same more or less, situated in the county
of Murray and town of Yass: Commencing at the south-east corner of allotment number
eleven; and bounded thence by the building line of Cooma-street, being a line bearing
east forty-five degrees south, southerly sixty-six feet; on the south-west by a line at
right angles to Cooma-street one hundred and thirty-two feet; on the north-west by a
line parallel to Cooma-street northerly sixty-six feet; and on the north-east by a line at
right angles to the building line of Cooma-street one hundred and thirty-two feet, to
the point of commencement.
