WINDSOR MUNICIPAL COUNCIL (HOBARTVILLE PUBLIC RESERVE) ACT. New South Gales ANNO VICESIMO ELIZABETHA I REGINA: HR KKK KKK KERR KK KOK KK KK ROKR KKK KR KE An Act to authorise the Council of the Municipality of Windsor to convey and transfer certain lands within the said Municipality in exchange for certain other lands; to amend the Local Govern- ment Act, 1919; and for purposes connected therewith. [Assented to, 16th November, 1971.] WHEREAS: Windsor Municipal Council (Hobartville Public Reserve). Elizabeth II Ve HEREAS: Preamble. (1) Hobartville Developments Pty. Limited and _ its (2) (3) (4) (5) (6) predecessors in Title have been and are the regis- tered proprietors of certain lands situate within the Municipality of Windsor (the Council whereof is hereinafter referred to as "the Council") being the whole of the land contained within Lot 1 in Deposited Plan 218126: By the registration of Deposited Plan 231320 certain land bounded in part by Laurence Street and Luttrell Street, Richmond, having an area of nineteen acres two roods twenty-one and _ three- quarter perches and being the land marked as Public Reserve in that Deposited Plan was vested in the Council in fee simple as a public reserve: The said Council has since held the said land for the purpose of providing a public reserve: In the interests of obtaining a more balanced sub- division the Council is willing to transfer to Hobart- ville Developments Pty. Limited a part of the said public reserve being the areas described in the First Schedule hereto and having a total area of eight acres three roods eighteen and one-half perches: In exchange for the transfer of the said areas described in the First Schedule hereto Hobartville Developments Pty. Limited is willing to transfer to the Council or dedicate in favour of the Council certain lands totalling in area twelve acres one and one-half perches and being more particularly described in the Second Schedule hereto: The Council has no authority under the Local Government Act, 1919, to transfer any part of a public reserve within the meaning of that Act: BE TET Windsor Municipal Council (Hobartville Public Reserve). BE it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows : — 1. This Act may be cited as the "Windsor Municipal Council (Hobartville Public Reserve) Act, 1971". 2. The Council of the Municipality of Windsor is hereby authorised and empowered to convey and transfer the lands described in the First Schedule hereto in fee simple freed and discharged from all trusts estates or interests affecting the same to Hobartville Developments Pty. Limited subject to the said Hobartville Developments Pty. Limited transferring to the said Council of the Municipality of Windsor in fee simple freed and discharged from all trusts estates or interests the lands described in the Second Schedule hereto which last- mentioned lands shall thereupon be held by the Council for public reserves within the meaning of the Local Government Act, 1919. SCHEDULES FIRST SCHEDULE ALL THAT piece or parcel of land situate at Richmond in the Parish of Ham Common County of Cumberland and State of New South Wales containing by admeasurement one acre thirty-six perches a little more or less being part of Lot 119 of Deposited Plan 231320 com- mencing at a point bearing 308 degrees 31 minutes 20 seconds for 133 feet 14 inches from the north western corner of Lot 61 of the said Deposited Plan and bounded thence on the north east by a line bear- ing 308 degrees 31 minutes 30 seconds for 113 feet 0.3/4 inches thence on part of the north west by a line bearing 264 degrees 23 minutes 15 seconds for 17 feet 24 inches to the south eastern side of Laurence Elizabeth 11 Snort title.
