An Act to enable His Eminenee the Most Reverend Patrick FrancisCardinal Moran, the Very Reverend John Felix Sheridan,the Reverend Patrick Leonard Dunne, John Bede Barlow,and Michael Hagerty,orother the trustees for the time being of certain lands situate at Waverley, to sell the said lands and to provide for the application of the proceeds thereof. [5th June, 1893. ] WEREAS by a certain grant from the Crown under the hand and seal of Sir Augustus William Frederick Spencer Loftus, Governor of the Colony of New South Wales, bearing date the twenty- third day of March, one thousand eight hundred and eighty-five, the lands deseribed in the Schedule hereto were granted unto the Most Reverend Patrick Francis Moran, the Very Reverend John Felix Sheridan, the Reverend Patrick Leonard Dunne, John Bede Barlow, and Michael ILagerty, and their heirs upon trust as a site for a Roman Catholic Church: And whereas it is expedient that the said lands should be sold, and that the proceeds to arise from such sale should be applicd in or towards the purchase of an cligible site for a Roman Catholic Church in the borough of Waverley, and the erection of such Church: Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same, as follows :— 1. After the passing of this Act, it shall be lawful for the sai¢ Patrick Francis Moran, John Felix Sheridan, Patrick Leonard Dunne. John Bede Barlow, and Michael Hagerty (hereinafter styled trustees) their heirs and assigns, or other the trustee or trustees for the time being of the said grant of the twenty-third day of March, one thousanc¢ e ight hundred and eighty-five, to sell and absolutely dispose of the sai lands by public auction or private contract, and either in one lot or several lots, as they shall deem most expedient, for such price or prices as can be had or obtained for the same, and when sold to convey the same or any part or parts thereof to the purchaser or purchasers in fee simple, freed and dise harged from the said trusts affecting the sume ; and the receipt in writing of the said trustees, their heirs or assigns, or of the trustees or trustee for the time being of the said grant, shall 'absolutely . Lee and Brady Settlement. absolutely discharge the purchaser or purchasers: of the said lands, or any part or parts thereof, from the purchase money payable by him or them from secing to the application of the said purchase money and from all liability as to the misapplication or non-application thereof. 2. The said trustecs, their heirs or assigns, shall stand possessed of all moneys arising from any and every such sale or sales as afore- said upon trust to apply the same, and the same shall be applied in and towards purchasing and paying for an el ligible site for a Roman Catholic Church in the borough of Waverley aforesaid, and building such Church; and the receipt of any person or persons to whom any moneys siall be paid under the provisions of this Act shall be valid and complete discharges to the said trustees, their heirs or assigns, for such moneys. . THE SCHEDULE REFERRED TO. All that piece or parcel of land in our said Colony containing by adincasurement two rood, be the same more or less, situated in the county of ( amberland and parish of Alexandria, at Waverley: Commencing on the eastern side of a road one chain wide at a point distant one chain east from the north-eastern corner of two roads (site fora poems ; and bounded thence on the west by that road dividing it from part of that land earing south two chains thirty-six links; on the south bya line beaving east two chains twelve "links ; ou the east by a 'line bearing north two chains thirty-six links ; and on the north by a rou one chain wide dividing it from S. WH. and J. Pearce's four acres two roods bearing west {wo chains twelve links, to the point of commencement.
