[Assented to, 15th December, 1975.] WHEREAS: Taree Municipal Council (Bourke Street Public Reserve Land Sale). WHEREAS : (1) (2) (3) (4) (5) (6) (7) (8) A plan of subdivision of lands at Taree has been duly registered in the office of the Registrar General as Deposited Plan 243085 : On registration in the office of the Registrar General of the said plan, Lot 28 therein was marked with the words, "public reserve" : By virtue of such registration and the provisions of the Local Government Act, 1919, the land com- prised in the said Lot was dedicated as a public reserve and vested in the Council for an estate in fee simple : Upon the registration of such plan as aforesaid the Registrar General issued to the Council a certificate of title under the Real Property Act, 1900, being Certificate of Title Volume 12022 Folio 165 indicating thereon that such land is held as a public reserve : Group 3 Leagues Club Limited is a company duly incorporated under the Companies Act, 1961 : The Company's objects include inter alia the fostering, development, promotion and encourage- ment of sports, athletics and physical culture in the Taree District : The Company is a Registered Club within the meaning of Part X of the Liquor Act, 1912: The said Company is the registered proprietor under the Real Property Act, 1900, of a parcel of land containing Six thousand one hundred and twenty- seven (6127) square metres : (9) Elizabeth II Preamble. (9) (10) (11) (12) (13) (14) The Company is a Purchaser under a Contract of Sale of a separate parcel of land containing an area of approximately 2.853 hectares and being the land comprised in Conveyance No. 38 Book 2253 : The said parcels of land are separated by that part of Lot 28 in Deposited Plan 243085 situate on the Southern side of a line bearing North-westerly to the Western boundary of the said Lot and being an extension of the Northern boundary of Lot 5 in Deposited Plan 512154 containing an area of 1 716 square metres : The Company desires to improve and develop the said lands but by reason of the aforesaid difficulty the implementation of these proposals is impeded : The Council has by Contract of Sale bearing date the Twenty-eighth day of August, One thousand nine hundred and seventy-five agreed to sell to the Company and the Company has agreed to buy from the Council the land separating the aforesaid lands of the Company for the sum of Nine hundred dollars ($900.00) subject to the approval of the Parliament of New South Wales : The Council has no authority under the Local Government Act, 1919, to sell and transfer any part of a public reserve within the meaning of the said Act : It is expedient to authorise the Council to sell the said land and to transfer the same to the Company for such consideration and in accordance with the terms and conditions of the said Contract entered into between them for an estate in fee simple freed and discharged from all trusts affecting the same : BE Taree Municipal Council (Bourke Street Public Reserve Land Sale). BE it therefore enacted by the Queen's Most Excellent Elizabeth 0 Majesty, by and with the advice and consent of the Legislative ——_ Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :— 1. This Act may be cited as the "Taree Municipal Council Short title (Bourke Street Public Reserve Land Sale) Act, 1975". and citation. 2. The Council of the Municipality of Taree is hereby Authority authorised and empowered to sell and transfer the lands to sell and described in the Schedule hereto and execute all instruments lands. required to effect such transfer to Group 3 Leagues Club Limited for the sum of Nine hundred dollars ($900.00) in fee simple free and discharged from all trusts affecting the same. 3. The proceeds of the sale shall be applied by the Council Application of the Municipality of Taree for the purpose of improvement Of Proveeds and development of public reserves within the Municipality. ALL THAT piece or parcel of land situate at Chatham in the Munici- pality of Taree Parish of Taree and County of Macquarie being Lot 1, Deposited Plan 579557 and part of the land comprised in Certificate of Title Volume 12022 Folio 165.
