An Act to adopt and deelare valid an amended Paes, alignment of Church-street in the Borough of Parramatta,and to authorize the Council of the said Borough to erect a public foun- tain and other buildings on land now part of said street, and for the other purposes hereinafter mentioned.

Parramatta Church-street Amended Alignment.
An Act to adopt and deelare valid an amended Paes,
alignment of Church-street in the Borough
of Parramatta,and to authorize the Council
of the said Borough to erect a public foun-
tain and other buildings on land now part
of said street, and for the other purposes
hereinafter mentioned. [28rd July, 1888. |
IEREAS the existing alignment of Church-street within the Preamble.
Borough of Parramatta between Macquarie-strect and Dareey-
street, and also in the vicinity of Albert-strect is defective and in-
convenient by reason of the narrowness thereof, the obstructive angles
therein, and the fixing of the public fountain so as to occupy the
building line of the said Church-street ; and it is expedient to adopt
and declare valid such re-alignment thereof as is hereinafter set forth :
Be it therefore enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the Legislative Council and Legis-
lative Assembly of New South Wales in Parliament assembled, and by
the authority of the same, as follows :—
1. After the passing of this Act the foot-ways and carriage-ways New alignment of
in Chureh-street from Macquaric-street southwards to the southern PetofChureh-street,
boundary of the Municipal Council Chambers premises, and from
Ilavold-strect to Albert-street within the Borough of Parramatta afore-
said, shall be in the places and of the dimensions shown on the plan of
the said portions respectively of the said street numbered six hundred
and forty-nine, and now deposited in the Lands Titles' Office, Sydney.
2. After the passing of this Act the picce of land situate at the New site for public
intersection. of Church-strect and Macquaric-street aforesaid, containing pow
ten and a quarter perches, granted to the said Council and its sucees-
sors as a site for a public fountain, hy Crown grant dated on or about
the thirteenth day of March, one thousand eight hundred and seventy-
four, under the hand of Lis Execlleney Governor Sir ILercules
tcbinson, and registered volume two hundred and forty-one folio one
hundred and nine, shall be deemed to be and shall become part of
Church-strect aforesaid, anything in the said grant to the contrary
notwithstanding, and the picce of land shown and delincated on the
said plan and thereon coloured blue, shall be used and sct apart asa
site for a public fountain and public buildings in the stead of the land
comprised in the said grant.
3. After the passing of this Act the carriage and foot-ways as Conformation of new
on the said plan shown, except thereout the said portion coloured blue, "™"*
shall for all purposes whatsoever be deemed to have been duly aligned
and set out under the authority of the Act second Victoria, number
two and the other laws in force within the Colony relating to the
alignment of streets within the said Town or Borough of Parramatta.
4. An office tracing or copy of the said plan and certified under Now alignments—
the hand of the Registrar-Gencral of the said Colony for the time being '¥ Prret.
shall, in all eases whatsoever at law or in equity be sufficient and
conclusive evidence of the alignment effectuated by this Act without
the production of the original plan ; and such Registrar-General or his
Deputy shall furnish to any person requiring the same such certified
copies or tracings as aforesaid whenever required, at the cost of ten
shillings cach.
5. After the passing of this Act the Council of the Borough of Council to have sole

appointed to be the new site for a public fountain, and may out of
the general revenue or other available funds of the said Borough, either
remove to the said site the public fountain now on the land so granted
as aforesaid, or may erect thereon another fountain in lieu thereof, and
a memorial building or structure in connection with the celebration of
the Centenary of the Colony in the said Borough, or such other building
or buildings as they shall think fit.
6. It shall be lawful for the Council of the said Borough and
its successors from time to time to make by-laws, rules, and regulations
for the use, government, and management of the said land hereby sct
apart as a site for a public fountain and coloured blue on the said
alignment plan, and the fountain and buildings thereon, and in any
such by-laws to fix maximum and minimum penalties for the neglect
or breach thereof ; and such by-laws shall have the force of law when
confirmed by the Governor and published in the Government Gazetle
in manner provided in regard to Municipal by-laws by the '" Munici-
palities Act of 1867," or other the Acts in force for the time being in
the said Colony in that behalf, but subject to the like conditions and
qualifications as contained in the said Act or Acts respectively:
Provided always that no such penalty shall exceed fifty pounds.
7. The production of the Government Gazette containing such
by-laws shall be conclusive evidence of such by-laws in any proceedings
at law or in equity whatsoever.
8. This Act may be cited as the " Parramatta Church-strect
Amended Alignment Act of 1888."
