TIEREAS, in the Borough of Newcastle, Perkins-strect and Preamble,
Chureh-street intersect and meet cach other, and Perkins-
street is of so steep a gradient that it is impossible to construct and
form the said intersecting and intersected streets in such a manner
that cach can be safely and conveniently used and enjoyed as public
roads and strects, by foot-passengers upon the footpaths, and by
passengers with or without horses, cattle, carriages, or other vehicles,
upon the roadways or carriageways thereof. And whereas it is
expedient and necessary for the convenience of the public using them
that the said streets should be constructed and formed so that the
safe and convenient use of each of them should be not entirely
interrupted. And whereas the said streets can be constructed and
formed so that they may be safely and conveniently used and enjoyed
by the public as public roads and strects, over a part of their present,
width, without wholly interrupting the safe and convenicnt use of

either of them, by slightly diverting the footpaths and roadways or
carriageways of the said streets, and by lessening the width of each
respectively at and near the intersecting or meeting portions thercof,
and by altering the levels and directions of portions of the said streets.
And whereas the Council of the said Borough cannot now lawfully
divert the said footpaths and roadways or carriageways, or alter the
levels thereof, in such a manner as would be necessary for the pur-
poses aforesaid. Be it therefore enacted by the Queen's Most Excellent
Majesty, by and with the advice and consent of the Legislative Council
and Legislative Assembly of New South Wales in Parliament assembled,
and by the authority of the same, as follows :—
1. It shall be lawful for the Council of the said Borough to
alter and lessen the width of the footpaths or carriageways or road-
ways of the said streets, or both the footpaths and the carriageways or
roadways thereof, at and within a reasonable distance from their mect-
ing or intersection, and to raise or lower the level of part of the said
streets for a portion of the width of the said streets, and to divert the
course of the said streets, and to build and maintain retaining walls,
and make and maintain embankments and excavations upon, in, or
across the said streets, and to do all other necessary work therein or
thereupon at and within a reasonable distance from such intersection or
mecting, although the existing course of the footways or roadways or
carriageways of such streets may thereby be obstructed or interrupted,
or their width lessened or their levels altered. Provided that at least
one footpath of not less than six fect in width, and a carriageway or
roadway of not less than twenty-five feet in width, shall be made, con-
tinued, and maintained from each of the said meeting or intersecting
streets into each of the said met or intersected streets for the free
use and enjoyment thereof as public roads and strects, by foot-
passengers of the footways thereof, and by passengers with or without
horses, cattle, carriages, or vehicles of any kind of the roadways or
carriageways thereof. Provided also that when Perkins-street shall
be diverted from its present course, at its junction with Church-strect,
as herein permitted, the roadway or carriageway of Church-strect
shall be maintained in the same direction as before such diversion, and
shall not be lessened in width by more than one-half of the width of
the existing roadway or carriageway thereof.
2. The diversion or alteration of the said streets, or cither of
. them, made by virtue of the powers herein conferred, shall be deemed
and taken to bea necessary work within the meaning and for the
purposes of the one hundred and nineteenth section of the '' Munici-
palities Act of 1867."
3. This Act may be cited as the " (Newcastle) Church and
Porkins Strects Act."
