[80th June, 1897. | 7 ILEREAS by a certain grant from the Crown under the hand Preamble. and seal of Sir Augustus William Frederick Spencer Loftus, Governor of the Colony of New South Wales, bearing date the twenty- third day of April, one thousand cight hundred and eighty-three, the lands particularly described in the First Schedule hereto were granted unto the Right Reverend William Lanigan, the Very Reverend Patrick Dunne, James M'Intyre, William M'Mahon, and Michael Quinn, being respectively trustees nominated and appointed under and by virtue of a an Act, 1897. Narandera Roman Catholic Church Trustees Enabling. an Act of the Governor and Legislative Council of the said Colony, made and passed in the seventh year of the reign of His late Majesty King William the Fourth, intituled " An Act to promote the building of Churches and Chapels, und to provide for the maintenance of Ministers of Religion in New South Wales," and to their heirs and assigns, upon trust for the appropriation thereof as the site of a dwelling-house, garden, and other appurtenances for the clergyman duly appointed to officiate in the Roman Catholic Church erected at N avandera, i in con- formity with the provisions of the said Act, so faras the same may apply to the trusts of the said grant, and for no other purpose whatsoever : And whereas by a certain grant from the Crown under the hand and seal of Sir Augustus William Frederick Spencer Loftus, Governor of the Colony of New South Wales, bearing date the twenty-third day of April, one thousand eight hundred and cighty-three, the lands particularly deseribed in the Second Schedule heretowere granted unto the said Right Reverend William Lanigan, the Very Reverend Patrick Dunne, James M'Intyre, William M'Mahon, and Michael Quinn, being respectively trustees nominated and appointed as aforesaid, and to their heirs and assigns, upon trust for the erection thereon of a Roman Catholic Church, in conformity with the provisions of the aforesaid Act, so far as the same may apply to the trusts of the said grant, and for no other purpose whatsoever: And whereas by a certain grant from the Crown under the hand and seal of Sir Augustus William Frederick Spenecr Loftus, Governor of the Colony of New South Wales, bearing date the twenty-third day of April, one thousand eight hundred and cighty-three, the lands particularly described in the Third Schedule hereto were granted unto the said Right Reverend William Lanigan, the Very Reverend Patrick Dunne, James M'Intyre, William M'Mahon, and Michael Quinn, being respectively trustees nominated and appointed as aforesaid, and to their heirs and assigns, wpon trust for the crection thereon of a Roman Catholic Church, in conformity with the provisions of the aforesaid Act, so far as the same may apply to the trusts of the said grant, and for no other purpose whatsoever : And whereas the said Very Reverend Patrick Dunne has since resigned from the said trusts reposed in him by the said several grants: And whereas the said Willam M'Mahon and Michael Quinn have since departed this life: And whereas in accordance with the provisions of the one hundred and sixth section of the Crown Lands Act of 1884, the Reverend Thomas Joseph Carroll, Peter Sullivan, and George Jerrom have been duly appointed trustees (in the places of the said Very Reverend Patrick Dunne, resigned, and the said Michael Quinn and William M*Mahon, deceased) of the said lands particularly deseribed in the said several Schedules hereto: And whereas John Patrick M'Intyre is the same person as is described as James M'Tntyre in the said several grants from the Crown hereinbefore mentioned : And Act, 1897. And whereas it is expedient that the said lands should be sold, and that the proceeds to arise from such sale should be applied in or towards the purchase of an cligible site fora Roman Catholic Church, and for a dwelling-house for the clergyman duly appointed as afore- said, in the parish of Narandera, in the town of Narandera aforesaid, and for the erection of such church and dwelling-house: Be it there- fore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :— 1. After the passing of this Act it shall be lawful for the said 'Trustees authorised Right Reverend William Lanigan, Thomas Joseph Carroll, Peter Sullivan, George Jerrom, and John Patrick M'Intyre, hercinafter styled trustees, their heirs and assigns, or other the trustee or trustees for the time being of the said several grants, of the twenty-third day of April, one thousand eight hundred and cighty-three, to sell and absolutely dispose of the said lands by public auction or private con- tract, and cither in one lot or several lots as they shall deem most expedient, for such price or prices as can be had or obtained for the sane, and when sold to convey the same or any part or parts thereof to the purchaser or purchasers in fee simple, freed and discharged from the said trusts affecting the same; and the receipt in writing of the said trustees, their heirs or assigns, or of the trustees or trustee for the time being of the said grants, shall absolutely discharge the purchaser or purchasers of the said lands, or'any part or parts thereof, from the purchase money payable by him or them from sceing to the application of the said purchase money, and from all liability as to the misapplica- tion or non-application thereof. 2. The said trustecs, their heirs or assigns, shall stand possessed Application of 1 proceeds, of all moneys arising from any and every such sale or sales as aforesaid upon trust to apply the same, and the same shall be applicd in and towards purchasing and paying for an cligible site fora Roman Catholic Church and dwelling-house as aforesaid, in the parish of Narandera, in the town of Narandera aforesaid, and building such church and dwelling- house ; and the receipt of any person or persons to whom any moneys shall he paid under the provisions of this Act shall be valid and com- plete discharges to the said trustees, their heirs or assigns, tor such moneys. 8. This Act may be cited as the " Narandera Roman Catholic Short title. Church Trustees Enabling Act of 1897." SCHEDULES, to sell. Act, 1897. Narandera Roman Catholie Church Trustees Enabling. SCHEDULES. THE FIRST SCHEDULE. All that piece or parcel of land in our said Colony, containing by admeasurement two roods, be the same more or less, situated in the county of Cooper and parish of Narandera, town of Narandera, allotment three of section thirty- nine: Commencing on the northern side of Twynam-strect, at the south-western corner of allotment four, appropriated for an extension to the site fora Roman Catholic Church; and bounded thence on the south by that street westerly two chains; on the west by the eastern boundary-line of allotment two northerly at right angles to Twynam-street two chains fifty links toa lane; on the north by that lane easterly parallel with Twynam-strect two chains ; and on the east by the western boundary-line of allotment four aforesaid southerly at right angles to Twynam-street two chains fifty links, to the point of com- mencement. THE SECOND SCHEDULE. All that piece or parcel of land in our said Colony, containing by admeasurement two roods, be the same more or less, situated in the county of Cooper and parish of Narandera, town of Narandera, allotment four of section thirty-nine: Commencing on the northern side of Twynam-strect, at the south-western corner of allotment five, appropriated for a Roman Catholic Chureh; and bounded thence on the south by that strect westerly two chains; on the west by the eastern boundary-line of allotment three, appropriated for a Roman Catholic presbytery northerly at right angles to Twynam- street two chains fifty links to a lane; on the north by that lane easterly parallel with Twynam-strect two chains ; and on the east by the western boundary-line of allotment five aforesaid southerly at right angles to Twynam-street two chains fifty links, to the point of commencement. THE THIRD SCHEDULE. All that piece or parcel of land in our said Colony, containing by admeasurement two roods one perch, be the same more or less, situated in the county of Cooper and parish of Narandera, town of Narandera, allotment five of section thirty-nine: Com- mencing at the south-eastern corner of the section; and bounded thence on the south by Twynam. strect westerly two chains two links and halfalink ; on the west by the eastern boundary-line of allotment four, appropriated for an extension to the site for a Roman Catholic Church northerly at right angles to Twynam-street two chains fifty links to a Jane; on the north by that lane easterly parallel with Twynam-street two chains and two links and half a link to East- street; and on the east by that strect southerly two chains fifty links, to the point of commencement.
