MUNICIPALITY OF HURSTVILLE (WOLLI CREEK, KINGSGROVE, PUBLIC RESERVE LAND SALE) ACT. New South Gales ANNO VICESIMO SECUNDO ELIZABETH I REGINAE RRR KKK KKK EK KK ERK KK RK KER RR KK KK An Act to enable the Council of the Municipality of Hurstville to sell certain lands adjoining Wolli Creek, Kingsgrove and transfer the same free of all trusts affecting such lands; to amend the Local Government Act, 1919; and for purposes connected therewith. [Assented to, 8th May, 1973.] WHEREAS : Municipality of Hurstville (Wolli Creek, Kingsgrove, Public Reserve Land Sale). HEREAS : (1) (2) (3) (4) (5) The Council of the Municipality of Hurstville (hereinafter referred to as "the Council") is the registered proprietor in fee simple of certain lands adjoining Wolli Creek, Kingsgrove containing 750 square metres and being the whole of the land comprised in Certificate of Title Volume 10192 Folio 47: The Council holds the lands subject to the provisions of section 340A of the Local Government Act, 1919, for the purposes of public garden and recreation space : The said lands are no longer suitable for, and are not in fact used by, the public for public garden and recreation space : The said lands have been valued at $6,500.00 : The Council has by Contracts of Sale bearing date the Twelfth day of March One thousand nine hundred and seventy-three agreed to sell part of the said lands (being the land described in the First Schedule hereto) to Associated Steamships Pty. Limited of 339 George Street, Sydney, for the sum of $5,335.00 and the remainder of the said lands (being the land described in the Second Schedule hereto) to Girin Limited of 111 Charles Street, Prahran, Victoria, for the sum of $1,165.00: (6) Elizabeth II Preamble. Elizabeth II Short title. Authority to sell and transfer lands. Municipality of Hurstville (Wolli Creek, Kingsgrove, Public Reserve Land Sale). (6) The Contracts are subject to the approval of the Parliament of the State of New South Wales. (7) The Council has no authority under the Local Government Act, 1919, to sell and transfer any part of a public reserve within the meaning of the said Act : (8) It is expedient to authorise the Council to sell the said land and to transfer the same to Associated Steamships Pty. Limited and Girin Limited for the expressed considerations of $5,335.00 and $1,165.00 and in accordance with the terms and conditions of the said Contracts entered into between them for an estate in fee simple freed and discharged from all trusts affecting the same : BE it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :— 1. This Act may be cited as the "Municipality of Hurst- ville (Wolli Creek, Kingsgrove, Public Reserve Land Sale) Act, 1973". 2. (a) The Council of the Municipality of Hurstville is hereby authorised and empowered to sell and transfer the lands described in the First Schedule hereto and execute all instruments required to effect such transfer to Associated Steamships Pty. Limited for the sum of Five thousand three hundred and thirty-five dollars in fee simple freed and discharged from all trusts affecting the same. (b) Municipality of Hurstville (Wolli Creek, Kingsgrove, Public Reserve Land Sale). (b) The Council of the Municipality of Hurstville is hereby authorised and empowered to sell and transfer the lands described in the Second Schedule hereto and execute all instruments required to effect such transfer to Girin Limited for the sum of One thousand one hundred and sixty- five dollars in fee simple freed and discharged from the trusts affecting the same. 3. The proceeds of the sale shall be applied by the Council of the Municipality of Hurstville for the purpose of the improvement and development of public reserves within the Municipality. SCHEDULES. FIRST SCHEDULE All that piece or parcel of land situated at Kingsgrove in the Municipality of Hurstville Parish of Saint George County of Cumber- land State of New South Wales being part of Lot 18 in Deposited Plan No. 16307 Commencing at the north western corner of Lot Z in Deposited Plan No. 417978 and bounded thence on the south west by a line being the north eastern boundary of a Drainage Easement 4.57 metres wide bearing 334 degrees 15 minutes 30 seconds distant 3.785 metres thence on the north west by the south eastern bank of Wolli Creek (now filled) being lines bearing firstly 28 degrees 7 minutes 40 seconds distant 16.285 metres secondly bearing 65 degrees 40 minutes distant 7.17 metres thence on the north east by a line bearing 155 degrees 10 minutes distant 8.335 metres thence on the north west firstly by the north western edge of concrete paving being a line bearing 65 degrees 10 minutes distant 25.11 metres thence by the aforementioned bank of Wolli Creek being lines firstly bearing Elizabeth ptf Application of proceeds of sale.
