cipality of Moruye to recover rates for the 2s:
year 1895 to 1896 on the basis of the rate
imposed for the year 1894 to 1895, and for
other purposes in connection therewith.

HEREAS the Council of the Municipality of Moruya omitted to Preamble.
comply with section one hundred and sixty-four of the Muni-
cipalities Act of 1867 by not making an estimate and imposing a rate as
provided in that section for the year one thousand cight hundred and
ninety-five to one thousand cight hundred and ninety-six : And whereas
it is expedient that the rate made and imposed for the year one thousand
eight hundred and ninety-four to one thousand eight hundred and
ninety-five be adopted as the rate for the year one thousand eight
hundred and ninety-five to one thousand cight hundred and ninety-six :
Be it therefore enacted by the Queen's Most Excellent J Majesty, by and
with the advice and consent of the Legislative Council and Legislative
Assembly of New South Wales in Parliament assembled, and by the
authority of the same, as follows :—
1. The rate imposed by the said council for the year one Rate for 1894 to
thousand eight hundred and ninety -four to one thousand eight hundred Re RTT
and ninety- "five shall be the rate for the year one thousand eight
hundred and ninety-five to one thousand cight hundred and ninety-six,
and shall be taken to have been duly made and imposed for such last
mentioned year in all respects as if it had been made and imposed for
that year within the time limited by section one hundred and sixty-
four of the Municipalities Act of 1867, and as if the other provisions
of the said section had been duly complied with.

2. It shall be lawful for the council to prosecute any actions, or
suits, or other proceedings necessary for the recovery of rates without
any further assessment or delivery of rate papers or notices ; and no
defendant in any such action, suit, or other proceeding as aforesaid
shall be entitled to set up as a defence any non-compliance by the
council with the provisions of the said one hundred and sixty-fourth
section, and the council may retain all moneys which have been paid
to it for rates, notwithstanding such non-compliance as aforesaid.
3. This Act may be cited as the "Moruya Municipal Council
Enabling Act of 1896."
