City of Sydney, to sell the said land and to
provide for the application of the proceeds

HEREAS by a certain grant from the Crown, under the hand
and seal of Sir Hercules George Robert Robinson, Governor
and Commander-in-Chief of the Colony of New South Wales, bearing
date the twentieth day of September, one thousand eight hundred and
seventy-eight, the land described in the Schedule hereto, being situate
in the Parish of Saint Phillip, in the City of Sydney, was granted
unto the Most Reverend Roger Bede Vaughan, and John Felix
Sheridan, Peter Young, Thomas Cooper Makinson, John Bridge, and
Michacl Landers, and their heirs, upon trust as a site fora Roman
Catholic Church and presbytery. And whereas the said Roger Bede
Vaughan departed this life on or about the eighteenth day of "August,

Kent-street Roman Catholic Church Land Sale.
one thousand eight hundred and eighty-three. And whereas it is
expedient that the said land should be sold, and that the proceeds to
arise from such sale should be applied in or towards the purchase of
another site for a Roman Catholic Church and presbytery in the said
parish and the erection of such church and presbytery or church only
within the parish aforesaid. Be it therefore enacted by the Queen's Most
Excellent Majesty, by and with the advice and consent of the Legisla-
tive Council and Legislative Assembly of New South W: ales in
Parliament assembled, and by the authority of the same, as follows :—
1. After the passing of this Act it shall be lawful for the said
John Felix Sheridan, Peter Young, Thomas Cooper Makinson, John
Bridge, and Michael Landers, their heirs and assigns, or other the
trustee or trustees for the time being of the land comprised in the said
grant of the twentieth day of September, one thousand eight hundred
and seventy-cight (hereinafter styled trustees), to sell and absolutely
dispose of the said land, by public auction or private contract, and
either in one lot or in several lots as they shall deem most expedient,
for such price or prices as can be had or obtained for the same, and
when sold to convey the same or any part or parts thereof to the pur-
chaser or purchasers in fee simple freed and discharged from the said
trusts affecting the same, and the receipt in writing of the trustecs, shall
absolutely discharge the purchaser or purchasers of the said land, or
any part or parts thereof, from the purchase moncy payable by him or
them from sceing to the application of the said purchase moncy, and
from all liability as to the misapplication or non-application thereof.
2. The trustees, their heirs or assigns, shall stand possessed
of all moneys arising from any and every such sale or sales as
aforesaid upon trust to apply the proceeds of such sale in or towards
purchasing and paying for an eligible site for a Roman Catholic
Church and presbytery in the said parish, in the city of Sydney afore-
said, and building such church and presbytery or church only, and
the receipt of any person or persons to whom any moneys shall be
paid under the provisions of this Act shall be valid and complete dis-
charges to the trustecs, their heirs or assigns, for such moneys. The
said proceeds shall be expended in the purchase of a new site and
towards the erection of such church and presbytery or church only
within five years from the date of the passing of this Act.
3. This Act may be cited as the " Kent-strect Roman Catholic
Church Land Sale Act."
THE SCHEDULE REFERRED TO.
All that piece or parcel of land in our said Colony, containing by admeasurement
one rood six perches, be the xame more or less, situated in the county of Cumberland,
parish of Saint Phillip, city of Syduey, part of section ninety-three : Commencing on the
western building line of Kent- street, at the north-eastern corner of allotment four ; and
bounded thence on the east by that building line bearing north thirteen degrees fifteen
minutes, west two chains thirty -five links ; on the north and west by lines. dividing it
from allotment five bearing west thirteen degrees fifteen minutes, south one chain
twenty-five links; and thence south thirteen degrees fifteen minutes, cast two chains
twenty. seven links ; and on the south by part of the northern boundary 'of allotment four
aforesaid, bearing about east nine degrees thirty minutes, north one chain twenty-five
links and three-fourths of a link, to the point of commencement.
