INVERELL Cutren or En@taxnp Lanp Saez. Preamble. An Act to enable the Right Reverend James Francis Turner D.D. Bishop of Grafton and Armidale William Clare Cardew James Harvey Hindmarsh and Georee Thomas Thankful Butler Trustees of certain lands situate in the town of Inverell to sell the said lands and provide for the appropriation of the proceeds thereof. [5th October, 1886.] HEREAS by two grants made by Lord Augustus Loftus and bearing date the sixth day of January one thousand eight hundred and eighty respectively Her Majesty the Queen granted the land described in the First and Second Sche odules here to unto William Clare Cardew James Harvey Hindmarsh and George Thomas Thankful Butler for an estate in fee-simple subject to the provisions of the Act of the Governor and Legislative Council of New South Wales eighth William Fourth number five upon trust to permit the erection and mainten- ance thereon of a church to be devoted to the worship of Almighty God according to the use of the church in the said Act described as "he United Church of England and Ireland" and a dwelling-house for the minister for the time being licensed or otherwise authorized to officiate in the chureh to be erected as aforesaid or in some other church to be erected in the neighbourhood thereof And whereas by a conveyance bearing date the tw enty-sev enth day of February one thousand eight hundred and eighiy-two and made between the late Colin Ross of the one part and James Francis Turner Bishop of Grafton 1886. 50° VIC. Lnverell Church of England Land Sale. Grafton and Armidale William Clare Cardew and James Harvey Hindmarsh of the second part the land specified in the Third Schedule hereto annexed was granted bargained sold alienated released and confirmed unto the said Bishop of Gratton and Armidale William Clare Cardew and James Harvey Hindmarsh to be used as a site for Church of England purposes And whereas it is expedient that the said Bishop of Grafton and Armidale William Clare Cardew James Ilarvey ilindmarsh and George Thomas Thankful Butler should be empowered to sell and dispose of the said parcels of land and to convey and assure the same according to their respective interests to the respective purchasers thereof free and discharged from the trusts incident thereto And that the proceeds of sale in cach case should be invested in premises as hereinafter provided Be it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by authority of the same as follows :— 1. It shall be lawful for the said Bishop of Grafton and Power to trustees to Armidale and his successors William Clare Cardeow James Harvey TLlindmarsh and George Thomas Thankful Butler their heirs adminis- . o . a trators and executors to sell and dispose of the lands severally described in the First Second and 'Third Schedules hereto annexed by public auetion or private contract and cither i in ove lot or several lots as the vendors exercising this power shall deem: expedient for sich price or prices as can be reasonably had or obtained therefor And to convey and assure the sme or any part thereof to the respective purchasers thereof in tec-simple freed and discharged from the trusts affecting the same And the receipt in writing of the said Bishop of Grafton and Armidale or his successors William Clare Cardew James Uarvey Uindmarsh and George Thomas Thankful Butler or their heirs administrators and exceutors shall be an absolute disc harge to every purchaser of such lands or of any part thereof in respect to the pur- chase money payable by him and shall exonerate him from seeing to the application thereof and from all liability as to the mis-application or non-application thereof. 2. The said Bishop of Grafton and Armidale and his successors Willian' Clare Cardew James Llarvey Ilindmarsh and George Thomas : Thankful Butler their heirs administrators and executors shall stand possessed of all moneys arising from the exercise of the powers of sale hereby conferred after paving thercout the costs of obtaining this present Act and all expenses incident to the sale of the said lands upon the following trusts namely :— (i) In the first place to apply such moncys or any part thereof in or towards payment for purchase of one acre of land adjoining the building now used as a Chureh of England in Lawrence- street Inverell on which is erected a substantial brick dwe ing- house and to permit the same to be used as a dwelling-house for the minister licensed and authorized to officiate in the said church adjoining. (11) And to apply the residuc of the said moneys if any in or towards payment of the debt now due on the said building used as a church in Lawrence-street aforesaid. flow proceeds of sale are to be applied. 3. This Act may be cited as the "Inverell Church of England short title. Land Sale Act of 1886." FIRS? 50° VIC. 1886. Kiss's George-street Property. FIRST SCHEDULE. All that piece or parcel of land containing by admeasurement one acre more or less situated in the county of Gough parish of Inverell and town of Inverell being allotment four of section seventy-two of the said town Commencing at the northern corner of the section and bounded thence on the north-west by Granville-street south- westerly two chains on the south-west by the north-eastern boundary-line of allotment three appropriated for a Church of England Parsonage south-easterly at right angles to Granville-street five chains threo links to Chester-street on the south-cast by that street north-casterly parallel with Granville-strect two chains to Lawrence-street and on the north-cast by that street north-westerly five chains three links to the point of commence- ment, SECOND SCHEDULE. All that piece or parcel of land containing by admeasurement two roods more or less situated in the county of Gough parish of Inverell and town of Inverell being allotment: three of section seventy-two of the said town Commencing on the south-eastern side of Granville-street at the northern corner of allotment two and bounded thence on the north-west by that street north-easterly one chain three links on the north-east by the south-western boundary-line of allotment four appropriated for a Church of England Church south-easterly at right angles to Granville-street five chains three links to Chester-street on the south-east by that street south-westerly parallel with Granville- street one chain three links and on the south-west by a line and the north-eastern boundary-line of allotment two aforesaid in all north-westerly at right angles to Granville-street five chains three links to the point of commencement. THIRD SCHEDULE, All that piece or parcel of land containing by admeasurement two roods more or less situated in the county of Gough (then unnamed) parish of Inverell and town of Inverell being allotment sold as lot thirty-two in pursuance of the proclamation of twelfth July one thousand eight hundred and sixty Commencing on the south-west side of Vivian-street at the northern corner of allotment six and bounded thence on the north-east by that street north-westerly two chains on the north-west by the south-cast boundary-line of allotment eight south-westerly at right angles to Vivian-street two chains and fifty links to a lane on the south-west by that lane south-casterly parallel with Vivian-street two chains and on the south-cast by the north-west boundary-line of allotment six aforesaid north-easterly at right angles to Vivian-street two chains and fifty links to the point of commencement.
