An Act to close and abolish that portion of Alstonville, High-street, lying between Commercial-road and the Avenue, and to vest the same Alexander Jol in Robert Gibson, William mston, and William Condie Renwick, as trustees for the Alstonville Agricultural Society.

An Act to close and abolish that portion of Alstonville, High-street, lying between Commercial-road and the Avenue, and to vest the same Alexander Jol in Robert Gibson, William mston, and William Condie Renwick, as trustees for the Alstonville Agricultural Society. ILEREAS portion of [23rd October, 1906. ] a certain roadway known as High-strect, described in the Schedule hereto, passes for its whole length between lands which are vested in the said Robert Gibson, William Alexander Johnston, and William Condie Renwick, as trustees for the Alstonville Agricultural Society formerly known as the Alstonville and Richmond River Farmers' Club Agricultural and Horticultural Society, under and upon th of trust dated the twelfth ¢ e trusts of a certain indenture of declaration ay of August, one thousand eight hundred and cighty-nine, made between Samuel Theophilus Northeott, of the first part, the Alstonvill e and Richmond River Farmers' Club Agricultural and Horticultural Socicty, of the second part, the said Robert Gibson, Owen Caw ey, the said William Alexander Johnston, and the said William Condie Renwick, of the third part, and Samuel Theophilus Northcott, Alexander Johnston, Wi Charles R. Lovegrove, Wi Robert Barlow, of the fourth part: Robert Gibson, Owen Cawley, William liam Condie Renwick, Andrew Conolly, liam Arthur Spratt, Thomas Brandon, and And whereas the said portion of High-street Higi-sTREET, ALSTONVILLE, CLosixc, Preamble. Vesting of land described in Schedule and closin of road over same. General issue may be pleaded in any proceeding. Act, 1906. High-street, Alstonviile, Closing. High-street is not bounded by any property other than that of the said Robert Gibson, William Alexander Johnston, and William Condie Renwick as such trustees as aforesaid, and is of no use to the public: And whereas the Alstonville and Richmond River Farmers' Club Agricultural and Iorticultural Society in the said indenture of the twelfth day of August, one thousand eight hundred and cighty-nine, referred to is now known as the Alstonville Agricultural Society Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament Assembled, and by the authority of the same, as follows :— 1. From and after the commencement of this Act it shall be lawful for the said Robert Gibson, William Alexander Johnston, and ® William Condie Renwick to close up that portion of the roadway known as Iligh-street, described in the Schedule hereto, and it shall be further lawful for the said Robert Gibson, William Alexander Johnston, and William Condie Renwick as such trustees as aforesaid under the said indenture of declaration of trust, their heirs, executors, administrators, and assigns, and for the trustces and trustee for the time being of the said indenture, and for all persons now or hereafter entitled or beneficially interested under the said indenture, to have the exclusive use and possession of the said land described in the Schedule hereto, and to prevent all persons from coming, or passing along, or in any way using the same, and the said last-mentioned and shall become, remain, and be vested in the said Robert Gibson, William Alexander Johnston, and William Condie Renwick as such trustees as aforesaid, and in their heirs, executors, administrators, and assigns, for an estate in fee simple in possession, but subject to the trusts of, and for the use and benefit of, the persons now or hereafter to be entitled under the said indenture of declaration of trust, and free from all rights, easements, and privileges of any person or body corporate then previously existing, or claimed in, over, or upon or in respect of the said land. 2, If any action or suit, or other legal proceeding, shall be instituted, issued, or taken by any person or hody corporate against the said Robert Gibson, William Alexander Johnston, and William Condic Renwick, or any or cither of them, or the trustees or trustee for the time being of the said indenture of declaration of trust, or any person now or hereafter claiming or entitled thereunder in respect of the said land described in the Schedule hereto, or of any right, easement, or privilege in respect thereof, or in respect of any thing done in the exercise of the powers hereby conferred, it shall be lawful for the said Robert Gibson, William Alexander Johnston, and William Condie Renwick, and each and every of them, their heirs, executors, administrators and assigns, and for the heirs, executors, administrators and Act, 1906. This Act may be cited as the " Iigh-street, Alstonville, Short title. Closing Act of 1906." SCHEDULE. The following is the Schedule above referred to. Aut that piece or parcel of land situated at Alstonville, in the parish of Tuckombil, county of Rous, and State of New South Wales, and comprising the site of portion of High-street commencing at the intersection of the eastern side of Commercial-road with the northern side of High-street ; and bounded thence on the north by the ncrthern side of High-streect, bearing easterly nine hundred and twenty-three links; on the east by part of the western side of the Avenue, bearing southerly one hundred links; on the south by the southern side of High-street, bearing westerly nine hundred and twenty- three links ; and thence on the west by part of the eastern side of Commercial-road, bearing northerly onc hundred links, to the point of commencement.
