Preamble.
Short title,

 JIEREAS in consequence of the by-laws which regulate the
charges for water supply in the" Municipal
having heen 'Tramed partly under section one hundred and sixty-six of
the " Municipalities Act of 1877" (now repealed) and partly under the
provisions of the ' Country 'Towns Water and Sewerage Acts of 1880,
doubts have been expressed as to the power of the said Borough to

said by-laws. And whereas the construction and completion of the
works in conneetion with the said water supply for the city of Goulburn
recover certain rates and charges which are due and pa
entailed a large expenditure of money advanced by t

Crown certain annual sums of money for interest upon the moneys so
advanced as aforesaid. And whereas it is desirable that such doubts
should be removed and that the said Borough should
rave full power
to recover all rates and charges made payable by the said by-laws. Be
it therefore enacted by the Queen's Most Excellent Majesty, by and
with the advice and consent of the Legislative Council
and Legislative
Assembly of New South Wales in Parliament assemb

1. This Act may be cited as the "Goulburn
Charces Act of 1890."

2. "From and after the passing of this Act, notwithstanding ¢ any
alleged defect or informality in by-law number one hundred and forty -
three of the Borough of Goulburn or any of the subsections of such
by-law, it shall be lawful for the said Borough i in respect of the period
intervening between the first January, one thousand cight hundred
and cighty- cight, and thirtieth June, one thousand eight hundred and
ninety, to procced for the recovery of all such rates and charges as are
made payable by the said recited by-law in the manner provided in
sections sixty and sixty-one in the « Country Towns Water and
Sewerage Act of 1880," or otherwise as directed by the said Act, and
the said Borough shall, as regards the rates as aforesaid, have all
the rights and remedies in respect of rates and charges for water supply
given by the said Act in the same manner that they would have had
if the said recited by-law were in entire accordance with the provisions
of the said Act. Provided always that the said Borough shall in no
case be entitled to recover more than a sum that would equal live per
centim per annum on the assessed value of the premises in respect of
which such water rate is payable or sought to be recovered.
