whereby it appeared, and it was by the indenture now in recital
witnessed, that, in consideration of the sum of ninety-one pounds paid
by the said William Lanigan to the Bank of New South Wales, the
said bank granted, bargained, sold, aliencd, released, and the said Joseph
Collins evanted, harg cained, sold, released, ratified, 'and confirmed unto
the said William Tanigs un and his heirs the lands and hereditaments,
being lots one, two, and three of seetion thirty, situate in the town of
Goulburn aforesaid, which ave more particularly described in the First
Schedule hereto, to hold the same unto and to the use of the said
William Lanigan, his heirs and assigns, for ever, freed and discharged
of and from all the moneys and interest secured thereon: And whereas
by an indenture dated the ninth day of November, in the year anno
domini one thousand eight hundred and seventy-five (registered on the
nineteenth day of November, anno domini one thousand eight hundred
and seventy-five, numbered eight hundred and eighty-four, book one
hundred and fifty-four), and expressed to be made between Robert
Henry Mariner lorster, of Sydney, in the Colony of New South Wales,
solicitor, of the one part, and the Right Reverend William Lanigan,
Roman Catholic Bishop of Goulburn, in the said Colony, of the other
part, after recitals whereby it appeared, and it was by the indenture
now in recital witnessed, that, in consideration of the sum of sixty-five
pounds fifteen shillings paid by the said William Lanigan to the said
Robert Henry Mariner Forster, the said Robert Henry Mariner Forster
bargained, sold, aliened, released, and confirmed unto the said William
Hanigan and his heirs the lands and hereditaments, being lots twelve
and thirteen of section forty-four, and lots fourteen, fifteen, and sixteen
of section fifty-nine, situate in the town of Goulburn aforesaid, which
are more particularly deseribed in the Second Schedule hereto, to have
and to hold the same unto and to the use of the said William Lanigan,
his heirs and assigns, for ever: And whereas by an indenture dated
the twenty-fourth day of October, anno domini one thousand cight
hundred and seventy-six (registered on the thirty-first day of October,
one thousand eight hundred and seventy-six, numbered eight hundred
and fifty-one, book one hundred and sixty-threc), and expressed to be
made between Thomas Bull, of Parramatta, in the Colony of New South
Wales, Esquire, and Michael Perry, of Yass, in the said Colony, surgeon,
of the one part, and the Right Reverend William Lanigan, of Goulburn,
in the said Colony, Roman Catholic Bishop of Goulburn, of the other
part, after recitals whereby it appeared, and it was by the indenture
now in recital witnessed, that, in consideration of the sum of sixty-five
pounds, paid by the said Right Reverend William Lanigan unto the

year anno domini one thousand cight hundred and seventy-seven
(registered on the tenth day of August, anno domini one thousand
eight hundred and seventy-seven, numbered seven hundred and thirty-
one, book one hundred and seventy-one), and expressed to be made
between Bridget O'Sullivan, of Hunter's Hill, near Sydney, in the
Colony of New South Wales, widow, of the first part, Kate Mary
O'Sullivan, of the same place, spinster, and Cecilia Agnes O'Sullivan,
also of the same place, spinster, of the second part, and William
Tanigan, of Goulbiun, in the said Colony, Bishop of the Roman
Catholic Church, of the third part, after recitals whereby it appeared,
and it was by the indenture now in recital witnessed, that, for the
consideration therein mentioned the said Br idvct O'Sullivan, as to her
estate, and the said Nate Mary O'Sullivan and Cecilia Agnes O'Sullivan,
as to their several estates respectively, granted, bargained, sold, aliened,
released, and confirmed unto the said William Lanigan and his heirs
the Jands and hereditaments, being Jot seventcen of section ten, situate
in the town of Goulburn aforesaid, which is more particularly described
in the Fourth Schedule hereto, to have and to hold the same unto and
to the use of the said William Lanigan, his heirs and assigns, upon
trust for the Roman Catholic Church, school, and charitable purposes
in the Diocese of Goulburn: And whereas by an indenture dated the
twenty-first day of July, anno domini one thousand cight hundred and
seventy-seven (registered on the tenth day of August, anno domini one
thousand cight hundred and seventy-seven, numbered seven hundred
and thirty-two, book one hundred and seventy-one), and expressed to
be made between Robert Henry Mariner Forster, of Sydney, in the
Colony of New South Wales, solicitor, of the one part, and William
Lanigan, of Goulbarn, in the Colony aforesaid, Bishop of the Roman
Catholie Church of the Diocese of Goulburn, of the other part, it was
witnessed that, in consideration of the sum of twelve pounds, paid by
the said W illiam Lanigan to the said Robert Ienry Mariner Jorster,
the said Robert ILenry Mariner Forster oranted, bargained, sold,
aliencd, released, and confirmed unto the s said W illiam Lanigan and his
heirs the lands and hereditaments, being lot seventeen, section fifty-nine,
situate in the town of Goulburn aforesaid, which is more particularly
deseribed in the Fifth Schedule hereto, to have and to hold the

one hundred and cighty-two) and expressed to be made between
William Stewart, of Goulburn, in the Colony of New South Wales,
blacksmith and wheelwright, of the one part, and the Right Reverend
William Lanigan, Lord Bishop of Goulburn, of the other part, it was
witnessed that, in consideration of the sum of two hundred pounds paid
to the said William Stewart by the said Right Reverend William
Lanigan, the said William Stewart granted, bargained, sold, alicned,
released, and confirmed unto the said Right Reverend William Lanigaa,
his heirs and assigns, the lands and hereditaments being lots, six, seven,
twenty-four and twenty-live, of seetion forty-two, situate in the town
of Goulburn aforesaid, more particularly described in the Sixth Sche-
dule hereto, to have and to held the same unto the said Right Reverend
William Lanigan and his heirs, to sueh uses, upon such trusts, and to
and for such ends and intents and purposes and in such manner as he
might by any deed ov willappoint, and in default of and until any such
appointment and so far as no such appointment should extend to the
use of the said Right Reverend William Lanigan, his heirs and assigns,
for ever: And whereas by an indenture dated the twenty-sixth day of
September, anno domini one thousand eight hundred and eighty-three
(registered on the fifth day of November, anno domini one thousand eight
hundred and cighty-three, numbered nine hundred and twenty-seven,
book two hundred and seventy-cight),and expressed to be made between
Jane Frances Stombuco, of Brisbane, in the Colony of Queensland, the
wile of Andrea Stombuco, of the same place, architect, of the first part,
and the Right Reverend William Lanigan, Roman Catholic Bishop of
Goulburn, in the Colony of New South Wales, of the other part, after
recitals whereby it appeared, and it was by the said indenture now in
recital witnessed, that, in consideration of the sum of nine hundred
pounds paid by the said William Tanigan to the said Jane Frances
Stombuco, the said Jane Frances Stombuco, in exercise of the powers
vestedin her, appointedandalso granted, bargained, sold, aliened, released,
and conveyed unto the said Right Reverend William Lanigan and his heirs
the lands and hereditaments, being lot eighteen, section ten, situate in
the town of Goulburn, which are more particularly described in the
Seventh Schedule hereto, to have and to hold the same unto and to the
use of the said Right Reverend William Lanigan, his heirs and assigns,
for cver upon trust for church purposes connected with the Roman
Catholic Church, Goulburn : And whereas by a memorandum endorsed
upon the last hereinbefore recited indenture in the handwriting of the
said William Lanigan, he did under his hand duly witnessed on the
thirteenth day of February, anno domini one thousand eight hundred
and ciehty-cight, declare that he held the lands, hereditaments, and
premises appointed and conveyed to him by the said last hereinbefore
recited

recited indenture in trust for the Roman Catholic Church purposes, and
that the Roman Catholie Bishop of Goulburn for the time being was to
be sole trustee and to declare what such purposes were, but that the said
lands and hereditaments were always to remain Roman Catholic
Church property: And whereas by an indenture dated the sixth day
of February, anno domini one thousand cight hundred and eighty-nine
(registered on the fourteenth day of February, anno domini one thousand
cight hundred and cighty-nine, numbered nine hundred and nineteen,
book four hundred and seven), and expressed to be made between
Andrew McGeorge, of Goulburn, in the Colony of New South Wales,
farmer, of the one part, and the Right Reverend William Tanigan,
Roman Catholic Bishop of Goulburn, in the said Colony, of the other
part, it was witnessed that, in consideration of the sum of one hundred
and seventy pounds paid by the said William Lanigan to the said
Andrew McGeorge, the said Andrew McGeorge granted, bargained,
sold, aliencd, released, conveyed, and confirmed unto the said William
Tanigan, and his heirs, the lands and hereditaments, being lot sixteen,
section ten, situate in the town of Goulburn, which is more particularly
described in the Eighth Schedule hereto, to have and to hold the same
unto and to the use of the said William Lanigan, his heirs and assigns,
for ever: And whereas the said Right Reverend William Lanigan
duly made his will, dated the thirtieth day of January, anno domini
one thousand eight hundred and ninety-seven, and thereby appointed
the Right Reverend Join Gallagher (then Coadjutor Bishop of the
toman Catholi¢ Church of Goulburn) and the Reverend James
Kennedy, of Burrowa, in the Colony of New South Wales, Roman
Jatholic priest, executors of the said will, and declared that any land
he purchased in Goulburn was purchased as Roman Catholic Chureh
property for Roman Catholic Church purposes, and he further declared
that all deeds wherein his name was found it was as trustee thereof
solely for the Roman Catholic Church purposes, and he further
purported to appoint the Roman Catholic Bishop of Goulburn for the
time heing as such trustee as aforesaid in his place after his death :
And whereas the said Right Reverend William Tanigan being then
scised, possessed of, or entitled to the lands and hereditaments deseribed
in the several Schedules hereto for the several estates of inheritance in
fee-simple, and for such other several estates as are hereinbefore recited,
and being then Roman Catholic Bishop of Goulburn, departed this life
on the thirteenth day of Junc, anno domini onc thousand nine hundred,
without having revoked ov altered his said will: And whereas probate of
the said will was, on the twenty-cighth day of August, anno domini one
thousand nine hundred, by the Supreme Court of New South Wales in
its probate jurisdiction, granted to the said Right Reverend John
Gallagher, then and now Roman Catholic Bishop of Goulburn
aforesaid, and the Reverend James Kennedy, the said executors
in

in the said will named: And whereas by an indenture dated the
twenty-third day of Septembey, anno domini one thousand nine hundred
and two (registered on the twenty-lirst day of October, anno domini one
thousand nine hundred and two, numbered two hundred and two, book
seven hundred and twenty-three), and expressed to be made between
the said Right Reverend John Gallagher and the said Reverend James
Kennedy, as such executors as aforesaid, of the one part, and the said
Right Reverend John Gallagher of the other part, the said Right
Reverend John Gallagher, the Roman Catholic Bishop of Goulburn,
and any person who should be his successor for the time being in that
office or bishopric, was duly appointed trustee of the said lands and
hereditaments described in the several Schedules hereto for the same
purposes on which the same were held by and in the place of the said
Right Reverend William Lanigan, deceased: And whereas it has been
found that the said lands and hereditaments deseribed in the said
several Schedules hereto being vacant lands do not produce any income
and are unsuitable for building any Roman Catholic Church, Roman
Catholic School or Charity House upon, and it is expedient that the said
lands and hereditaments in the said several Schedules hereto should be
sold, and that the proceeds to arise from such sale should be applied in
or towards any of the purposes hereinafter appearing: Be it therefore
enacted by the King's Most Execllent Majesty, by and with the advice
and consent of the Legislative Council and Legislative Assembly of
New South Wales in Parliament assembled, and by the authority of the
same, as follows :—
1. From and after the passing of this Act, it shall be lawful for
the said Right Reverend John Gallagher, Roman Catholic Bishop
of Goulburn, aforesaid, hereinafter styled the trustec, his heirs and
assigns, or other the trustees or trustee for the time being, of the
said lands and hereditaments described in the said several Schedules
hercto, to sell and dispose of the said lands and hereditaments deseribed
in the said several Schedules hereto by public auction or private
contract, and cither in one lot or in several lots as they shall deem
expedient, and for such price or prices as can be reasonably obtained
for the same, and upon such terms and conditions of sale as the trustee
or other the trustees or trustee for the time being may deem expedient,
and to buy in the said lands and hereditaments or any part or parts
thereof at any auction sale, or to rescind or vary the terms of any
contract for the sale of the said lands and hereditaments, or any part
or parts thereof, and when sold to convey and assure the same or
any part or parts thereof to the purchaser or purchasers thereof in fee-
simple, freed and discharged from all trusts affecting the same, and to
receive the purchase moueys thereof. And the receipt in writing of
the trustee, his heirs or assigns, or other the trustees or trustee
for the time being of the said lands and hereditaments for the purchase
money

moncy arising from such sale or sales shall be an eifectual aud absolute
sufficient discharge to the purchaser or purchasers of the said lands and
hereditaments or any part or parts thereof, and
them from seeing to the application of the sa

liability in respect of the misapplication or non-application thereof,
2. The trustee, his heirs or assigns, or other the trustees or
trustee for the time being of the said lands and
in the said several Schedules hereto, or of the
sales of the said lands and hereditaments, or of
stand possessed of the moneys arising from
aforesaid upon any of the following trusts, tha

proceeds of any sale or
any part thereof, shall
such sale or sales as
is to say :—
(a) To purchase lands for any purpose connected with the Roman
Catholic Church or any Roman Cat
iolic School or Charity
within the Roman Catholic Diocese of Goulburn, and should
the trustee see fit to erect any building thereon.
(b) To pay for, maintain, and support
Chureh, School, or Charity within t
any Roman Catholic
ie said diocese, and to
pay the salary or wages of any person employed therein.
(c) To dispense such charity amongst the
oor, infirm, aged, and
sick of the said diocese in sueh manner as the trustee in his
absolute discretion shall see fit.
(d) For such Roman Catholie Church purposes, Roman Catholic
School purposes, and Charitable purposes, within the said
diceese, as the trustee shall in his absolute diseretion sce fit.
. And the receipts of the person or persons to whom any moneys shall
be paid by the trustee, his heirs and assigns, cr other the trustees or
trustee for the time being, of the said lands and hereditaments or of the
proceeds of any sale thereof under the provisions of this Act, and the
declaration of the trustee or other the trustees or trustee for the time
being under his or their hand as to any moneys applied under subsection
(c) hereof shall be valid and complete discharges to the trustee, his
heirs and assigns, or other the trustees or trustee for the time being
for such moneys.

by admeasurement thirty-six perches, be the same more or less, situated in the town and
parish of Goulburn, county of Argyle, being allotment number one of section number thirty:
Commencing on the north western side of Lagoon-strect, at the southernmost corner of
the section ; and bounded on the south-west by a linc north-westerly at right-angles to
Layoon-street one chain ninety-two links to Auburn-strect ; on the north-west by part of
the south-eastern side of Auburn-strect north-easterly one chain twenty-one links ; on the
north-east by a line south easterly parallel to the south-western boundary two chains sixty
links to Lagoon- street ; aml on the south-east by one chain of the north-western side of
Lagoon- street south-w sterly to the southernmost corner of the section as aforesaid, being
the land sold as lot one in pursuance of the proclamation of the sixth day of September, 5
