Crookwell Roman Catholic Church Land Sale. i An Act to enable the Right Reverend William cxooxws:, rows Lanigan the Reverend Michael Slattery Daniel O'Brien and Michael Tully Trustees of certain land in the County of King Parish of Crookwell Town of 'Crookwell to sell the said land and to provide for the appropriation of the proceeds thereof. [1st July, 1887. ] CarHo.ic CHURCH Lanp Sate, HEREAS by a grant from the Crown bearing date the first day Preamble. of February in the year of our Lord one thousand eight hundred and seventy-eight the land specified in the First Schedule hereto was granted unto the said Right Reverend William Lanigan the Reverend Michacl Slattery and Daniel O'Brien and Michael Tully their heirs and assigns upon trust for the erection thereon of a Roman Catholic Church And whereas by a grant from the Crown bearing date the first day of February in the year of our Lord one thousand eight hundred and seventy-eighttheland specified inthe Second Schedule hereto was granted unto the Right Reverend William Lanigan the Reverend Michael Slattery Daniel O'Brien and Michael Tully their heirs and assigns upon trust for the appropriation thereof as the site of a dwelling-house garden and other appurtenances for the clergyman duly appointed to officiate in the Roman Catholic Church And whereas it has been found that the said sites fora church and presbytery are unsuitable for the purposes for which they were respectively granted and it is expedient that the said land should be sold and that the proceeds to arise from such sale should be applied in or towards the erection of a church and presbytery upon another site and for other purposes hereinafter mentioned Be it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :— 1. It shall be lawful for the said Right Reverend William Power to cell. Lanigan and Reverend Michael Slattery Daniel O'Brien and Michael Tully or other the 'Trustees or Trustee for the time being hereinafter styled Trustees to sell and dispose of the said land described in the Schedules hereto either by public auction or private contract and either in one lot or in several lots as they shall deem most expedient and for such price or prices as can be had or obtained for the same and upon such terms and conditions of sale as the said Trustees may deem expedient and to buy in the said lands or any part or parts thereof at any auction sale or to rescind or vary the terms of any contract for the sale of the said lands or any part or parts thereof and transfer and assure the same or any part or parts thereof in fee simple to the purchaser or purchasers thereof his her or their assigns freed or discharged from each and all the trusts affecting the same and the receipt in writing of the said Trustees their heirs or assigns shall be an effectual discharge to the purchaser or purchasers of the said land or any part or parts thereof and shall exonerate him or them from seeing to the application of any proceeds of such sale or sales and from all liability as to the mis-application or non-application thereof. 2. The said Trustees their heirs or assigns shall stand possessed Disposal of proceeds. o of all moneys arising from each and every such sale or sales as afore- said and after the payment of the actual and reasonable expenses of such Short title, dL? City of Goulburn Gas and Coke Company's Amendment. such sale or sales and of this Act upon trust to apply the proceeds of such sale or sales towards the erection of a Roman Catholic Church and Presbytery in the town of Crookwell and the receipts of any person or persons to whom any moneys shall be paid under the provisions of this Act shall be valid and complete discharges to the 'Trustees their heirs and assigns for such moncys. 3. This Act may be cited as the " Crookwell Roman Catholic Church Land Sale Act of 1887." SCHEDULES. FIRST SCHEDULE. All that piece or parcel of land in our said Colony containing by admeasurement one acre be the same more or less situated in the county of King and parish of Crook- well town of Crookwell allotments one and two of section seventeen commencing at the western corner of the section and bounded thence on the south-west by Cowper-street south-easterly four chains on the south-east by the north-western boundary line of allotment three appropriated for a Roman Catholic Presbytery north-easterly at right angles to Cowper-street two chains fifty links to a lane on the north-east by that lane north-westerly parallel with Cowper-street four chains to Spring-street and on the north- west by that street south-westerly two chains fifty links to the point of commencement. SECOND SCITEDULE. All that piece or parcel of land in our said Colony containing by admeasurement two roods be the same more or less situated in the county of King and parish of Crook- well town of Crookwell allotment three of section seventeen commencing on the north- eastern side of Cowper-street at the southern corner of allotment two being part of the appropriation for a Roman Catholic Church and bounded thence on the south-west by that street south-easterly two chains on the south-east by the north-western boundary line of allotment four north-easterly at right angles to Cowper-strect two chains fifty links to a lane on the north-east by that lane north-westerly parallel with Cowper-street two chains and on the north-west by the south-eastern boundary line of allotment two aforesaid south-westerly at right angles to Cowper-street two chains fiffy links to the point of commencement.
